RWA takes animal body to court

Five months after the Delhi High Court, on a plea by dog lovers, directed the Animal Welfare Board of India (AWBI) to identify spots across the capital for feeding stray canines, the panel finds that the task may not be that easy. Protests against the move reached a new level on Monday. 

The Resident Welfare Association (RWA) of a high-rise residential complex for central government employees —M S Apartments on KG Marg, abutting Hyderabad House, Civil Services Society and Andhra Bhawan — has dragged the Board to the court for identifying a feeding spot within the campus “despite protests”.

The RWA virtually questioned the Board’s power to allocate a feeding spot in densely-populated areas. 

The court had, on December 18, 2009, asked the Board to find designated places in all colonies in consultation with RWAs, SHOs and animal welfare organisations of each area.

The role of RWA's in nation building

The members & office bearers of the RWA's are the persons who are willing to work for the society. They can spare some time out of the busy schedule and that's why they join the RWA. If allowed & authorised properly, the RWA's can play a vital role in nation building.

The planting of trees in localities, maintaining the parks, Educating the local residents about water harvesting, about Child Labour, Keeping an eye on civic problems to avoid spread of diseases in the localities, Spreading awareness for cleaning of water coolers regularly as well a lot more can be included in the activities of the local RWA's.

Only 25% of properties in Delhi are paying property tax. If taken in confidence, this figure can break the records with the help of the local RWA's. These can be used to keep an eye on the neighbourhood. These can also be used in managing the traffic at critical points. Members of these RWA's can be taken as SPO's, Traffic police monitors etc. They can also be included in the local committees formed by various authorities such as MCD, Electricity, Jal Board etc.

But it depends upon the Government policies that how much use they want to take out of these local RWA's. In any case, there is least doubt in saying that these RWA's can play a vital role in nation building.

Empowerment of RWA's

I had attended this meeting in Town Hall Ch.Chowk, as Secretary RWA Pocket-3,Mayur Vihar-1, Mr. O.P. Sehgal President Federation Mayur Vihar-1 was also present in this meeting. The Presentation was elaborated by the Ch. Engineer MCD. During open discussion it was pointed out that the norms for the security Gates were too general and shall not fit for every place and every entry-Exit point. The only common point which needs the attension are that :

1) The Gates must be maned round the clock.

2) The Hight and width of the Gates must not block the entry of Fire tenders, Ambulance, etc. at the time of emergency during day and night.

3) If entry gate Exit gates are avilable the above system be stritly followd. Only one gate should be used at Night from 10.00PM to 6.0 AM for security of the residents.

4) If only one entry & Exit gate is available for opening and closing the gates must have security guards ( minimum 2) round the clock.

5) If the RAW is following the above norms properly than WHY & HOW RWA should be accountable for any mishaps ? Where is mishap in installing such security gates ? What about House braking / thefts /chain snatching / Acid throwing etc. every where even after the security gates are there or not ?

It is observed that many times, mostly at nights, some drunk car drivers or Trucks with building materials or Delivery vans/ trucks of Tent suppliers force their entry, late at night, from the gate which is closed ! where as the other gate is open BUT these persons are seen fighting and abusing and beating the duty Gaurds to get the Closed gates open as per their desires ? During marriges, even in nearby place, it has become a show off to park cars in side the gates at will and open drinking starts on car tops ? The Gaurds dare to stop this at the gates ! RWA has NO powers to check/stop this and the Police/MCD is not to be seen there. Should RWA be held accountable for these activities ? by just installing gates only.

Where are the powers with the RWA to set right such unlawful activities by the residents or outsiders ? The only action taken by the RWA is to call Police help, which, we all know how fast is this task to get police help ? at the time of actual need.

Therefore, it is my humble suggestion to the authorities to form watch & Ward committees of Sr.Citizens from the recommendations of the Residents of that Area and RWA to have the powers to directly co-ordinate with Area Police, MCD, DJB, Power supply etc.officials MLA or Muncipal Councelor to help the Residents as well as Govt. agencies at the time of need to have peace, security and proper community services to all.

RWAS and EMPOWERMENT ISSUE

Coperative Act 2003 and subsequent ammendments provided winding up of Societies (and setting up of association or what ever name you) and ensuring that all residents could become members.
Societies having properties like community centre etc were given two years to wind up or evolve a structure so that all residents could be members.
Through this esteemed blog, i had raised this issue, but unfortunately no body commented upon it.
It is correct there is no empowerment of RWAS and societies( like our DELHI OFFICERS CO OPERATIVE HOUSE BUILDING SOCIETY LTD MADHUVAN) failed to act. There may be hundreds of societies which have outlived the purpose( plots handed out to members, services handed to MCD OR OTHER RELEVANT AGENCIES)for these were created.
These societies charge maintenance and securitity charges.
The residents have no say. Maintenance means payment of staff salary or maintenance of community centre building.
Community centre is a income generating unit as plenty of money is received by way of booking charges.
The residents have no say either in any affair( like security or maintenance charges).
On a reference by one of resident of Madhuvan(member of societies since 1960s on ward) Registrar Co operative societies has directed our society to act in accordance with provisions of ACT.
The above reference was made by Sh. A.C Agarwal hony secretary of MRWA Madhuvan new delhi 110092.
I think it is high time we initiate discussion and some body advises us correct legal position.
Let us have informed information to enable to act in the true spirit of law and in the interest of citizens of delhi.

EMPOWERMENT OF RWA's

The Municipal Corporation of Delhi issued Guidelines for installation of security gates in Colonies in June 2007. As per the Guidelines, the office bearers of the respective RWAs have been made fully responsible and accountable for any mishap due to colony'ssecurity gates. All security gates have to be manned by guards to be hired by the RWAs.
All these responsibilities have been arbitrarily thrust upon the RWAs without any empowerment. RWAs have no source of income; funds have to be collecrted from the residents. It has beenexperienced that many of the residents do not pay, and the RWA has no authority to force them to pay. This issue has been raised by us as well as several other RWAs in various meetingswith the Hon'ble Chief Minister several times. But, no success so far. We don't know if someone, someday would consider this legitimate long-pending demand of the RWAs!
